1. PURPOSE

These General Terms and Conditions of Sale (“GTC“) apply exclusively to the online sale of AW Innovation products (hereinafter referred to as “Réjeanne”) on the website www.rejeanne-underwear.com (hereinafter the “Site”).

2. SCOPE OF APPLICATION

The GTC exclusively govern online sales contracts between Réjeanne (the “Seller“) and customers who are classified as consumers.

These GTC, along with the online order confirmation, constitute the legally binding contract between the parties.

Promotional materials such as brochures, catalogs, or product photos are for illustration purposes only and are not legally binding.

The GTC and all contractual information provided on the Site are written in French.

3. AVAILABILITY & ACCEPTANCE

The GTC are made available to consumers on the Seller’s website, where they can be directly accessed.

The GTC are binding on the consumer, who acknowledges having read and accepted them by checking a designated box before placing an order.

The validation of the order through its confirmation constitutes the buyer’s full and unconditional acceptance of the GTC in effect on the date of the order.

4. MODIFICATIONS TO THE GTC

Réjeanne reserves the right to modify the GTC at any time.

The applicable GTC are those in effect at the time of the order. A copy of the current terms can be provided to the customer upon request.

5. GTC CLAUSES

The nullity of a contractual clause does not result in the nullity of the GTC.

The temporary or permanent non-enforcement of one or more clauses of the GTC by the Seller shall not be interpreted as a waiver of the Seller's right to enforce the remaining clauses, which shall continue to remain in effect.

6. PRODUCTS

Each product available for sale on the Site has a detailed description.

Product photos are for reference only and do not constitute a legal contract.

The products comply with the applicable regulations concerning safety and consumer health, fair commercial practices, and consumer protection at the time they are placed on the market.

The products also adhere to the legal requirements of French law in effect at the time of their market release.

If neither option is accepted by the customer, a full refund will be processed within 7 days.

7. PRICING

7.1. Product Prices

The selling prices of each product listed on the Site are displayed in euros (€), inclusive of all applicable taxes, but excluding shipping and transportation costs, which are specified before order validation and charged separately.

The total amount due by the consumer is clearly indicated on the order confirmation page.

The applicable selling price of a product is the one in effect on the date of the order.

The selling price does not include shipping fees, which are charged in addition to the product price.

Any additional taxes, duties, or import fees required under French or foreign regulations (including those of the importing or transit country) remain the responsibility of the buyer.

In the event of a promotional offer, the Seller agrees to apply the discounted price to any order placed during the promotional period as advertised.

7.2. Price Modifications

Réjeanne reserves the right to adjust prices at any time, but the price at the time of purchase remains valid for the customer.

7.3. Additional Fees

Any extra costs related to delivery or shipping will be clearly indicated before order confirmation.

8. OFFER

The online sales offers presented on the Site are available to consumers worldwide, subject to any country-specific restrictions. International deliveries are carried out in accordance with the conditions specified at the time of order.

Unless otherwise specified, online sales offers remain valid as long as the products are displayed on the Site and subject to stock availability.

The consumer's acceptance of an offer is confirmed through the double-click process, finalizing the order confirmation.

9. ORDERS

To place an order, the consumer must:

1. Add products to their virtual shopping cart, specifying the desired quantities.
2. Click on the “Order” button and provide the necessary shipping and payment information.

Before clicking “Confirm Order”, the consumer has the opportunity to:

• Review the order details and total price.
• Return to previous pages to correct any errors or modify the order if needed.

By confirming the order, the consumer accepts the GTC, thereby forming a binding contract.

The Seller will send an order confirmation email, including payment acknowledgment, as soon as possible.

Any modifications to the order after confirmation are subject to the Seller’s prior approval.

The Seller reserves the right to refuse any order for legitimate reasons, particularly if the quantities ordered appear unusually high for a consumer purchase.

The sales contract is officially established once the consumer confirms the order.

10. PAYMENT

Payments can be made immediately at checkout via credit card or PayPal or in installments using Oney Bank’s "3x 4x Oney" payment option.

Our partner, Oney Bank, offers a financing solution (“3x 4x Oney”) that allows you to pay for your purchases between €100 and €3,000 in 3 or 4 installments using your credit card.

a) Conditions

This offer is available exclusively to individuals (legal adults) residing in France who hold a Visa or MasterCard with an expiration date later than the chosen financing period.

The following cards are not accepted:

• Cards requiring systematic authorization (e.g., Electron, Maestro, Nickel).
• Virtual cards (e-cards).
• Indigo and American Express cards.

b) Subscription Process

After completing your order, simply click on the "3x 4x Oney payment by credit card" button.

You will be redirected to the Oney Bank payment page, where you will see a detailed summary of your order and financing request, which you must validate.

You will then be required to:

• Enter your personal details or log in with your 3x 4x Oney account credentials if you already have one.
• Review the general terms and conditions for installment payments, provided in a downloadable PDF format for your reference.
• Confirm your acceptance electronically by ticking the designated checkbox.

By completing the double-click validation process, along with checking the box for acknowledging the terms, you irrevocably accept the installment payment conditions.

Unless proven otherwise, the transaction records stored by Oney Bank serve as proof of all financial transactions between you and Oney Bank.

If you request financing through Oney Bank, the order details will be shared with Oney Bank for the purpose of evaluating your eligibility, as well as for credit approval, management, and collection.

Oney Bank reserves the right to approve or reject your financing request.
You have a 14-day withdrawal period to cancel your credit agreement.

c) How It Works

Paying in 3 or 4 installments by credit card allows you to split your payment as follows:

• An initial deposit, charged on the order shipment confirmation date, equal to one-third or one-fourth of the order total, plus applicable fees:
  • 1.45% of the total amount for 3-installment payments (max fee: €15).
  • 2.2% of the total amount for 4-installment payments (max fee: €30).
• Subsequent installments:
  • For 3-installment payments, the remaining amounts are charged at 30 and 60 days after the first payment.
  • For 4-installment payments, the remaining amounts are charged at 30, 60, and 90 days after the first payment.

Examples:

• 3-Installment Plan (for purchases between €100 and €3,000)
  Example: For a €150 purchase, the initial deposit is €52.18, followed by two monthly payments of €50.

  • Loan duration: 2 months
  • Fixed APR: 19.26%
  • Financing cost: €2.18 (capped at €15 max).

• 4-Installment Plan (for purchases between €100 and €3,000)
  Example: For a €400 purchase, the initial deposit is €108.80, followed by three monthly payments of €100.

  • Loan duration: 3 months
  • Fixed APR: 19.31%
  • Financing cost: €8.80 (capped at €30 max).

11. DELIVERY

Delivery is defined as the transfer of physical possession or control of the product to the consumer.

For information on delivery times, please refer to the "Delivery" section located at the bottom of the homepage.

Products are delivered to the address provided by the customer during the order process.

For mainland France, deliveries are carried out by La Poste (service fees apply, charged by Réjeanne).

If the product does not match the order, the consumer must submit a claim to the Seller to request either:

• A replacement product, or
• A cancellation of the sale.

If a product becomes unavailable at the time of delivery, the Seller may offer a product of equivalent quality and price.

Failure to deliver the order in full will result in the automatic cancellation of the sales contract.

12. LEGAL WARRANTY OF CONFORMITY & WARRANTY FOR HIDDEN DEFECTS

All products provided by the Seller are covered by the legal warranty of conformity as per Articles L221-1 and seq. of the French Consumer Code and the warranty for hidden defects as per Articles 1641 and seq. of the French Civil Code.

The consumer has a two (2)-year period to claim either of these warranties:

• For non-conformity, the warranty period starts from the date of delivery.
• For hidden defects, the period starts from the date the defect is discovered.

If an apparent defect, non-conformity, or hidden defect is confirmed after expert review, Réjeanne commits to fully refunding the customer, including return shipping costs, within a maximum of fourteen (14) days.

However, Réjeanne cannot be held liable for any misuse of the products by the customer.

13. CLAIMS

Any claims related to the warranties must be sent by email to bonjour@rejeanne.com or by mail to AW INNOVATION, Customer Service, 1 rue Brémontier, 75017 Paris, France

The consumer will be reimbursed for return shipping costs no later than thirty (30) days after the Seller receives the returned product.

14. LIABILITY

The Seller cannot be held liable for any failure or improper execution of the contract if caused by:

• The buyer (e.g., incorrect use or handling of the product).
• An unforeseeable and unavoidable event caused by a third party.
• Force majeure (e.g., natural disasters, strikes, pandemics).

Additionally, the Seller cannot be held liable if the product does not comply with the regulations of the buyer’s country. It is the consumer’s responsibility to check whether the product is legally allowed for sale and use in their country.

15. ORDER CANCELLATION

In cases where cancellation is applicable under these GTC, the order may be terminated by a registered letter with acknowledgment of receipt or an electronic notification.

The cancellation will take effect immediately upon receipt of the request.

16. RIGHT OF WITHDRAWAL AND RETURNS 

 

16.1 RIGHT OF WITHDRAWAL

The consumer has a legal period of 14 calendar days from the date of receipt of the goods to exercise their right of withdrawal, without the need to provide any justification or pay any penalties.

The customer will be refunded in full upon receipt and verification of the returned items, and no later than 14 days after notifying their decision to withdraw.

Réjeanne may delay the refund until the returned items have been received at our warehouse or until proof of shipment is provided, whichever occurs first.

Refunds will be issued using the same payment method used for the original transaction.

To exercise the right of withdrawal, the consumer must notify Réjeanne by submitting a clear and unambiguous request via email: bonjour@rejeanne.com or by mail at the following address: AW INNOVATION, Customer Service, 1 rue Brémontier, 75017 Paris, France.

In the event of a withdrawal, the consumer must return the goods to AW Innovation's headquarters (1 rue Brémontier, 75017 Paris, France) without undue delay and no later than 14 days after notifying their decision to withdraw.

The deadline is considered met if the consumer sends the items before the 14-day period expires.

The consumer is responsible for covering the direct return shipping costs.

16.1 RETURNS

You may return unworn items with their original tags by contacting us within 30 days of receipt at bonjour@rejeanne.com.

For purchases of multi-item packs (e.g., sets of two or three items), returns for a refund must include all items in the original pack. Partial returns will not be accepted for refunds.

Please note that washed, worn, or tagless underwear cannot be returned.

We do not offer direct exchanges on our website www.rejeanne-underwear.com. If you need a different size, style, or color, simply place a new order on our e-shop!

17. INTELLECTUAL PROPERTY

All elements featured on this Site (photographs, visuals, texts, designs, images, etc.) are the exclusive property of Réjeanne and are protected under intellectual property law, including copyright and trademark rights.

Any reproduction or distribution of these materials without prior written authorization may result in legal action.

18. PROCESSING OF PERSONAL DATA 

The processing of personal data collected via the Site is intended for order management purposes.

The consumer is informed that this automated data processing system has been declared to the CNIL (French Data Protection Authority).
